Update
On Efforts to Bring Abortionist George R. Tiller To Justice
Wichita, KS - On Monday, July 28, 2008, District Court Judge Clark V. Owens
released a 35-page opinion
on Tiller’s constitutional challenge to the Kansas post-viability abortion
ban, saying that “K.S.A. 65-6703 survives all of the constitutional
challenges” presented by Tiller. Judge Clark therefore denied Tiller’s
motion to dismiss the 19 criminal charges against him.
This ruling will send Tiller to trial to face allegations that he illegally
aborted 19 viable babies without first having obtained the second concurring
opinion from an unaffiliated Kansas physician. If convicted, Tiller faces the
possibility of 19 years in jail.
The following day, Judge Owens denied
Tiller’s request for a jury of 12 and ruled that the case could proceed
with the state-mandated six jurors for misdemeanor cases.
A trial date has been set for March 16, 2009. However, a week-long hearing has been scheduled to begin on
November 17, 2008, where Tiller’s legal team is expected to present a motion
to suppress the 19 abortion records upon which the charges against Tiller are
based.
Tiller has been charged with committing illegal late-term abortions without
having sought the second concurring opinion of a second Kansas physician who is
legally and financially unaffiliated with him.
Instead, abortionist Ann Kristin Neuhaus provided the second signature
for all Tiller’s post-viability abortions even though she had illegal
affiliations with him.
Operation Rescue has announced that it will conduct prayer vigils and a
prophetic witness during the November hearing and the March, 2009, trial.
This campaign, which will be known as “A Call For Justice,” will also
include a multi-media public awareness campaign.
If
convicted, Tiller could face up to 19 years in jail and face the revocation of
his medical license.For

Wichita, KS – Attorney General Paul Morrison has announced that he is filing
19 misdemeanor charges against late-term abortionist George R. Tiller because
he used a second physician that was not financially or legally unassociated
with him, as required by law.
Tiller is scheduled for arraignment on August 7 at 10:30 AM in the Sedgwick
County District Court in Wichita.
Operation Rescue has been reporting
since August, 2006, that they suspected that Tiller’s association with
Dr. Ann Kristen Neuhaus was an illegal one. Neuhaus was listed as a witness
when Former Attorney General Phill Kline filed 30 criminal charges against
Tiller last December. Those charges were dismissed on shaky jurisdictional
grounds.
In his announcement, Morrison trivialized the murder of late-term children
by calling the charges a “technical violations.”
“While we are happy that charges are being filed against Tiller, we are
guarded about this because we believe that these charges are the weakest
against Tiller. There is now a pattern of illegal activity by abortionist
Tiller and Kline’s investigation is proven to have merit,” said Operation
Rescue President Troy Newman.
“Now, because we have charges on the 2003 records, we insist that
Morrison subpoena the 2004 and 2005 abortion records. Furthermore, in order
for justice to be done, the criminal late-term abortion charges against
Tiller, as supported by Psychiatrist Dr. Paul McHugh must be reinstated,”
said Newman.
Kline filed 15 charges alleging illegal late-term abortion were committed
by Tiller for reasons such as so a woman could go to a rock concert.
“We believe the filing of charges against Tiller vindicates Kline’s
investigation of Tiller,” said Newman. “There is a pattern of abuses and
illegal activity that is going on at Tiller’s mill. This is just the tip of
the iceberg.”

On January 13, 2005, a healthy 19-year old disabled
girl named Christin Alysabeth Gilbert died at a hospital in Wichita,
Kansas, from complications to a third trimester abortion procured at Women’s
Health Care Services, and abortion mill owned by the notorious George R.
Tiller.
Fortunately, Christin’s tragedy is perhaps
the best-documented abortion-related death in the history of Roe v. Wade.

Kansas Laws Violated?
There exists probable cause for an
investigation into Christin’s death. Information uncovered in numerous
documents has been carefully reviewed by attorneys and physicians who have
indicated that laws of the State of Kansas may have been violated.

manslaughter
Involuntary
manslaughter is the unintentional killing of a human being committed:

Recklessly;

During the commission of a lawful act in an unlawful manner.

Mistreatment of
a dependent adult is knowingly and intentionally committing one or more of
the following acts:

Those
providing the abortion did not take proper steps to report to the local
authorities that a Down Syndrome female was pregnant due to a criminal
assault.

prohibited when fetus viable, exceptions; determination of age of fetus;
determination of viability; reports; retention of medical records; viable,
defined; criminal penalties.
Christin was in her 28th
week of pregnancy, having just entered the third trimester, when subjected
to the
abortion.
No charges have ever been filed against
late-term abortionist George R. Tiller in the death of Christin A. Gilbert.
A complaint against Tiller was filed with the Kansas State Board of
Healing Arts, the agency responsible for discipline in the medical profession.
However, in spite of thousands of calls and e-mails from concerned citizens
demanding disciplinary action against Tiller for Christin's death, that board determined on November 23, 2005, that there was
no violation of the healing arts act and have closed the case against Tiller. In fact, the lack of interest in Christin’s death by the
authorities and the media indicates that there may be a cover-up in progress.
If there is to be justice for Christin,
it will have to be brought with the help of the people of Sedgwick County,
Kansas.
Here’s how…
The
State of Kansas provides that the citizens may call for the convening of a Grand
Jury though a petition process (KSA
22-3001). It
takes only 2,850 signatures of Sedgwick County registered voters to force a
Grand Jury investigation. Once the
Grand Jury convenes, they have the power to fully investigate
Christin’s death and any other possible criminal activity at Women’s
Health Care Services.
Your
help is needed to gather signatures calling for a Grand Jury to investigate
Christin’s death. As long as
those responsible for Christin’s needless death are allowed to escape justice,
women remain at risk of suffering a similar fate.

The Grand Jury investigation is
currently underway. Judge Richard Ballinger is overseeing the
